Eligibility Requirements

To use our Services, you must:

• Not be prohibited from using our Services under applicable laws
• Not be located in a restricted jurisdiction
• Complete our identity verification (KYC) process
• Provide accurate and complete registration information

Account Creation

When creating an account, you agree to:

• Maintain and promptly update your account information
• Keep your login credentials confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not create multiple accounts without authorization
• Not share, sell, or transfer your account to others

Identity Verification (KYC)

All users must complete our Know Your Customer (KYC) verification process:

• Basic Verification (Tier 1): Government-issued ID and selfie
• Enhanced Verification (Tier 2): Proof of address and additional documentation
• We reserve the right to request additional information at any time
• Failure to complete verification may result in account restrictions
• Your information is processed in accordance with our Privacy Policy

Account Security

You are responsible for:

• Maintaining the security of your password and 2FA codes
• Any losses resulting from unauthorized account access
• Ensuring your device and internet connection are secure
• Monitoring your account for suspicious activity
• Immediately reporting any security breaches

We are not liable for losses due to compromised credentials unless resulting from our negligence.

What We Are Not

Fordie Exchange is NOT:

• A bank, financial institution, or money transmitter
• An investment advisor or financial planner
• A cryptocurrency wallet service (we facilitate exchanges only)
• A trading platform for speculation or day trading
• Providing tax, legal, or accounting advice
• Guaranteeing profits or returns on cryptocurrency

How Transactions Work

1. You initiate an exchange by entering the amount and selecting currencies
2. We display the exchange rate, fees, and final amount you'll receive
3. You confirm the transaction and receive a unique wallet address
4. You send cryptocurrency to the provided address
5. We verify the blockchain transaction
6. We process the bank transfer to your account
7. You receive confirmation once complete

Exchange Rates and Fees

• Exchange rates are based on real-time market prices plus our spread (1-2%)
• Service fees range from 0.5% to 1% depending on transaction volume
• Rates are locked when you confirm the transaction
• Rates may change between viewing and confirmation
• Bank transfer fees are covered by us (no additional charges)
• Blockchain network fees are paid by you (the sender)
• All fees are clearly displayed before confirmation

Important rules:

• Cryptocurrency transactions are irreversible once confirmed on the blockchain
• You cannot cancel a transaction after sending cryptocurrency
• We cannot reverse transactions sent to incorrect addresses
• Double-check all transaction details before confirming
• Contact support immediately if you notice an error
• Refunds are only possible in case of our system errors

Illegal Activities

• Money laundering or terrorist financing
• Fraud, theft, or financial crimes
• Purchasing illegal goods or services
• Tax evasion or avoidance
• Violating sanctions or export controls
• Any activity prohibited by applicable law

Platform Abuse

• Using bots, scripts, or automated tools
• Attempting to manipulate exchange rates
• Creating multiple accounts to evade limits
• Providing false information or fake documents
• Attempting to hack or compromise our systems
• Interfering with other users' transactions
• Reverse engineering our platform

Financial Misconduct

• Using stolen funds or cryptocurrencies
• Processing transactions for third parties (acting as intermediary)
• Structuring transactions to evade reporting requirements
• Using our Services for gambling or betting
• Conducting transactions with proceeds of crime

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

No Investment Advice

We do not provide investment, financial, tax, or legal advice:

• Exchange rates and information are for reference only
• We make no recommendations about buying or selling cryptocurrency
• You are solely responsible for your investment decisions
• Cryptocurrency trading carries significant risk of loss
• Past performance does not indicate future results
• Consult qualified professionals before making financial decisions

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORDIE EXCHANGE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of cryptocurrency value or market fluctuations
• Losses due to user error or compromised credentials
• Third-party actions (banks, payment processors, blockchain networks)
• Service interruptions, delays, or technical failures
• Any amount exceeding the fees paid to us in the 12 months preceding the claim

Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Your Right to Terminate

You may close your account at any time by contacting customer support. You will remain liable for all obligations incurred prior to termination. We will process any pending transactions and return funds according to your instructions.

Our Right to Terminate

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms
• Suspected fraud or illegal activity
• Failure to complete KYC verification
• Providing false information
• Chargebacks or payment disputes
• Inactivity for more than 12 months
• Any reason we deem necessary to protect our platform or users

Effect of Termination

Upon termination: (1) your right to access and use our Services immediately ceases; (2) all outstanding obligations and liabilities remain in effect; (3) we may retain your information as required by law or regulation; (4) provisions that by their nature should survive termination will continue to apply.

Informal Resolution

Before filing a claim, you agree to contact us at legal@fordieexchange.com and attempt to resolve the dispute informally for at least 30 days. Provide your name, account information, and a detailed description of the dispute.

Binding Arbitration

If informal resolution fails, you agree that any dispute will be resolved through binding arbitration rather than in court, except:

• You may bring claims in small claims court if they qualify
• Either party may seek injunctive relief in court

Arbitration will be conducted under the rules of a recognized arbitration body in your jurisdiction. The arbitrator's decision is final and binding.

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. YOU MAY NOT ACT AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
